Section 22
Grant of subsistence allowance
(1) If the Government of Nepal is unable to provide minimum employment to the unemployed persons listed in the Employment Service Center, they will provide subsistence allowance of fifty percent of the amount equal to one hundred days of the minimum wage specified by the Ministry in a financial year subject to the specified conditions.
(2) Notwithstanding anything written in subsection (1), if an unemployed person is employed for a period of less than one hundred days in a financial year, subsistence allowance shall be provided only in an amount equal to fifty percent of the minimum wage prescribed by the Ministry for the remaining period of one hundred days.
(3) An unemployed person receiving subsistence allowance according to sub-section (1) shall comply with the prescribed conditions.
(4) Subsistence allowance under this section shall be given only in the following cases:-
(a) If any member of the family does not get employment as prescribed,
(b) To families with annual income less than prescribed by the Government of Nepal,
(c) If no member of the family is self-employed,
(d) No member of the family has gone for foreign employment. Explanation: "Foreign employment" refers to the situation of going to work abroad after obtaining a work permit from the Government of Nepal.
(5) Notwithstanding anything written in sub-section (4), those receiving regular pension or retirement benefits from government funds or other countries or international or intergovernmental associations, organizations or any other organization or from social security funds or other funds related to the assistance of the Government of Nepal or the employer on a regular basis No subsistence allowance will be given to the family of a person receiving any kind of assistance. Explanation: For the purposes of this section, "Government fund" means any of the following funds:-
(a) the accumulated fund or other government funds of the Government of Nepal, the provincial government or the local level, (b) the fund of a local institution, corporation, board, authority, establishment or any similar body wholly or partially owned by the Government of Nepal, the provincial government or the local level,
(c) Funds operated by grants received from the Government of Nepal, State Government or local level,
(d) A fund established in accordance with prevailing laws to provide pensions to persons holding public office.
(6) Other arrangements related to subsistence allowance to be provided under this section shall be as prescribed.
